IMPORTANCE OF GREENHOUSE GAS RULES

On 3 June 2010, the USEPA published the PSD/Title V Greenhouse Gas Tailoring Rule, which is the first U.S. federal rule to impose permitting and potential control requirements for GHG emissions at stationary sources of air emissions. The Tailoring Rule requires certain PSD-major, new or modified GHG sources to determine and implement Best Available Control Technology (BACT) for GHG emissions. Implementation of BACT for GHGs via PSD air permit applications and/or inclusion of GHG emissions and related operating permit and/or regulatory requirements in Title V air permit applications will occur in stages, beginning 2 January 2011.

Regulation of GHG emissions significantly impacts MSW Landfills; many landfills will be subject to the federal PSD program for the first time. There is very little precedent for addressing GHG’s in any air permit and USEPA has not yet issued guidance on the issue.

Industry representatives met with USEPA on July 20 to present initial recommendations on determining PSD applicability and GHG BACT for landfills to assist USEPA in developing guidance for regulatory agencies. Specific issues discussed included: determining Potential to Emit (PTE)/impact of fugitive and biogenic emissions, establishing GHG BACT for landfills, competing BACT/LAER for multiple pollutants and common control.

This session will provide industry interpretation of PSD/Title V applicability for GHG to MSW Landfills and recommendations for preparing PSD/Title V permit applications, including PTE calculations. The session will also provide an overview of discussions with EPA regarding guidance and interpretations. Dialogue on the issues and implementation approaches is encouraged during this session. Attendance is recommended for air permit consultants, landfill owners and operators, landfill environmental managers and landfill gas developers.
